Terms of Service

Welcome to TapTap (available at https://taptap.africa). By accessing or using our platform, NFC wristbands, QR code system, and related services (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use the Services.
1. Definitions
- “Platform” means the TapTap website, mobile services, and backend infrastructure.
- “User” means any person who registers an account or uses a wristband or QR code through the Platform.
- “Event Organiser” means an entity that creates and manages events on the Platform.
- “Vendor” means a seller of goods or services at an event who accepts payments through the Platform.
- “Wristband” means the NFC-enabled wristband issued to Users for cashless payments.
- “QR Code” means the scannable code issued to Users as an alternative to the wristband.
2. Account Registration
To use the Services, you must:
- Provide accurate and complete registration information, including a valid Kenyan phone number.
- Be at least 18 years old, or have the consent of a parent or legal guardian if between 13 and 18.
- Keep your account credentials confidential. You are responsible for all activity under your account.
- Notify us immediately of any unauthorised use of your account at support@taptap.africa.
3. Wristband & QR Code Usage
- The wristband and QR code are the property of TapTap and must be returned upon request or at the end of the event where required.
- You may not tamper with, duplicate, or modify the wristband or QR code.
- Lost or stolen wristbands must be reported immediately. You may freeze your account through the Platform to prevent unauthorised use.
- We are not liable for losses resulting from delayed reporting of lost or stolen wristbands.
- The QR code is for your personal use only and may not be shared, transferred, or reproduced.
4. Payments & Top-Ups
- All top-ups are processed through M-Pesa (Safaricom PLC). Transaction times and limits are subject to M-Pesa terms.
- Funds loaded onto your wristband or QR account are held in trust and are available for use at participating event vendors.
- Unused balances are auto-refunded to your M-Pesa account within 24 hours of an event’s end, minus any applicable platform fees.
- Platform fees are disclosed at the point of transaction and currently set at 2% unless otherwise stated.
- We reserve the right to adjust fees with 30 days’ notice.
5. User Responsibilities
You agree not to:
- Use the Services for any unlawful purpose or in violation of Kenyan law.
- Attempt to gain unauthorised access to our systems or other users’ accounts.
- Use the Services to facilitate money laundering, fraud, or other financial crimes.
- Interfere with the operation of the Platform or any event using TapTap.
- Provide false information during registration or dispute resolution.
6. Event Organiser & Vendor Terms
Event Organisers and Vendors agree to:
- Accurately represent their events and products on the Platform.
- Process all on-site payments exclusively through TapTap during the event period.
- Ensure their staff are trained to accept wristband and QR code payments.
- Settle any platform fees and transaction charges as agreed in their separate service agreement.
- Comply with all applicable Kenyan tax laws, including VAT and income tax obligations.
7. Refunds & Disputes
- Unused wristband/QR balances are auto-refunded within 24 hours post-event.
- Disputes regarding specific transactions must be raised within 14 days via email to support@taptap.africa.
- We will investigate all disputes and aim to resolve them within 7 business days.
- Refunds for disputed transactions are at our discretion and may require cooperation from the Vendor.
8. Limitation of Liability
To the fullest extent permitted by Kenyan law, TapTap and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services. Our total liability shall not exceed the total amount of platform fees paid by you in the twelve (12) months preceding the claim.
9. Account Deletion
You may delete your account at any time through the Settings page of your account portal. Upon deletion:
- All personal data is permanently erased from our active systems within 30 days.
- Transaction records are retained in anonymised form for seven (7) years to comply with tax and regulatory obligations under Kenyan law.
- Any unspent balance will be refunded to your M-Pesa account within fourteen (14) days.
- Account deletion is irreversible. If you wish to use the Services again, you must create a new account.
10. Termination by Us
We may suspend or terminate your access to the Services at any time for breach of these Terms, fraudulent activity, or conduct that harms the Platform or other users. Upon termination, your unspent balance will be refunded within fourteen (14) days, less any applicable fees.
11. Governing Law
These Terms are governed by the laws of the Republic of Kenya. Any disputes arising from these Terms shall be resolved through arbitration in Nairobi, Kenya, in accordance with the Nairobi Centre for International Arbitration (NCIA) Rules.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Platform. Continued use of the Services after changes take effect constitutes your acceptance of the new Terms.
